Subject: Broadcast of advertising messages during the live rebroadcast (“streaming”) of television and radio programs on the Web – authorization by the UDA

Dear Sir,

Following our recent advisory caution regarding talent fees (member artists of the UDA) on the broadcast of advertising messages during the live rebroadcast (“streaming”) of television programs on the Web, we want to apprise you of the results of our discussions with the Union des Artistes.

The UDA authorizes, at no additional cost, the simultaneous broadcast of advertising messages in certain live television or radio programs on the Web, in the absence of specific provisions in the UDA/JPC collective agreement – June 1, 2004 to May 31, 2007. The UDA considers that: “these commercial messages are network advertisements, advertisements broadcast simultaneously on more than one network station and that the parties agree to discuss this issue upon the renewal of the UDA/JPC collective agreement at the beginning of 2007.”

Consequently, this authorization allows, at the present time, the broadcast of advertisements during the live rebroadcast (“streaming”) of television or radio programs on the Web – advertising messages that were initially intended for a network broadcast on conventional television or radio.

Rest assured that we are pursuing our discussions with the UDA respecting this issue. Should there be any amendments to the present authorization, you will be informed without delay. Also, we have informed the broadcasters of UDA's position respecting this issue.
